Patents and Limited Label License
Lucigen’s vectors incorporating the CloneSmart® transcription-free cloning technology are the subject of U.S. Patent No. 6,709,861 and pending patent applications owned by Lucigen Corporation. The consideration paid for these products grants a Limited License to use the purchased amount of products pursuant to the terms set forth in the Limited Label License. Except where stated otherwise, the Limited License specifically excludes manufacture of additional vector derived from these kits. Academic, Not-for-Profit and For-Profit institutions acquire certain limited nontransferable rights with the purchase of these products. A complete description of the Limited License rights and limitations accompanies these products and is available from Lucigen on request. Lucigen’s CopyRight® vectors and Replicator™ competent cells are covered by U.S. Patent No. 5,874,259 and patents-pending licensed to Lucigen. By purchasing these products, the purchaser receives a limited use license for life science research applications.
OverExpress™, HI-Control™ BL21(DE3), and E. cloni® EXPRESS products are sold under a license issued to Lucigen Corporation by Brookhaven Science Associates, LLC (BSA) for noncommercial research purposes only. A separate license is required for any commercial use, including the use of these materials for research purposes or production purposes by any commercial entity. Some applications in which Lucigen’s EconoTaq® DNA Polymerase can be used may be covered by patents issued and applicable in the United States and certain other countries. Because purchase of this product does not include a license to perform any patented application, users of these products may be required to obtain a patent license depending upon the particular application in which the product is used. The PCR process is the subject of European Patent Nos. 201,184 and 200,262 owned by Hoffman-LaRoche. Those patents expired on March 28, 2006. The corresponding PCR process patents in the United States expired on March 29, 2005.
The CleanAmp™ dNTPs contained in Taq98™ Hot Start 2X Master Mix are provided with a non-transferrable right from TriLink BioTechnologies, Inc. to use the purchased CleanAmp™ dNTPs in internal research conducted by the buyer, whether the buyer is an academic, non-profit, or for-profit entity. A license is required for any commercial use of CleanAmp™ dNTPs, regardless of the academic or non-profit status of the using entity. Information about commercial licenses for CleanAmp™ dNTPs may be obtained from TriLink BioTechnologies, Inc. Buyer may not use the CleanAmp™ dNTPs to support the filing of a patent application in any country in the world that contains claims directed to CleanAmp™ dNTPs or uses thereof without the express approval of TriLink BioTechnologies, Inc.
